Welcome to Prysm (tryprysm.com, “the Website”), operated by SPECTRE PRYSM S.à r.l.-S(“Company,” “we,” “us,” or “our”). By accessing or using our website, SaaS tools, Chrome extension, and related services (“Services”), you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree with these terms, please do not use our Services.

These terms comply with U.S. laws (including the California Consumer Privacy Act – CCPA, Digital Millennium Copyright Act – DMCA, and CAN-SPAM Act) and European laws (including the General Data Protection Regulation – GDPR and ePrivacy Directive).

By using Prysm, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. You agree not to use our Services for unlawful purposes, including:

• Scraping or collecting data in violation of third-party rights or platform rules.
• Attempting to hack, disrupt, or exploit security vulnerabilities.
• Harassing, spamming, or impersonating creators or other users.
• Using our Services in violation of applicable data protection laws.

Violation of these terms may result in suspension or termination of your account.

You may need to create an account to access certain features. You are responsible for the accuracy of your account information, keeping your credentials secure, and all activity under your workspace. You must notify us promptly if you suspect unauthorized access.

Prysm is a content creator tracking workspace that lets teams track creators, save social content, organize folders, and keep research context across TikTok, Instagram, and YouTube. Features, usage limits, and availability may vary by plan or commercial agreement and may change over time as we improve the product.

Prysm operates on a subscription-based model. By subscribing, you agree to recurring charges processed through third-party providers (e.g., Stripe); we do not store your card details.

• No Refunds: Payments are non-refundable, except as required by law.
• Cancellation: You may cancel anytime, but you will not receive a refund for unused periods.
• Failed Payments: If payment fails, we may suspend your access until the issue is resolved.

By installing and using the Prysm Chrome extension, you agree that:

• Non-Transferable License: The extension is licensed, not sold. You may not resell, sublicense, or distribute it.
• Data Access: The extension may access publicly available web data to enhance functionality; it does not bypass security measures or access restricted content.
• Prohibited Activities: You may not scrape data in violation of third-party terms, automate interactions beyond intended use, or reverse-engineer the extension.

We may modify or discontinue the extension at any time. Continued use constitutes acceptance of any updates.

All content, trademarks, and proprietary technology on Prysm are owned by SPECTRE PRYSM S.à r.l.-S. You may not copy, reproduce, or distribute our software, data, or branding without permission. We comply with the DMCA; if you believe content on Prysm infringes your rights, send a takedown request to contact@brandsearch.co.

Prysm relies on third-party platforms and data sources. Metrics, thumbnails, links, and profile information may be delayed, unavailable, or inaccurate when upstream sources change. You must obtain proper permissions before using third-party information for commercial purposes.

Prysm is provided “as is” without warranties of any kind. We are not responsible for:

• Loss of profits, data, or business opportunities.
• Third-party service failures (e.g., payment gateways, hosting providers).
• Compliance failures due to incorrect or outdated user-provided data.

Our total liability shall not exceed the amount paid by you in the last 6 months.

We may update these terms at any time. Continued use of our Services after changes means you accept the updated terms.

These terms are governed by Luxembourg law. Any disputes shall be resolved in Luxembourg, unless another jurisdiction is required by law. For users in the U.S., disputes must first go through good-faith negotiation before arbitration under the applicable rules.

Prysm is not affiliated with, endorsed, or sponsored by TikTok, Meta, Instagram, YouTube, Google, or any of their subsidiaries. All trademarks remain the property of their respective owners. Any mention of these companies is for informational purposes only.
